Summary

USCIS announced on January 12, 2023 the final phase of a multi-year expansion of premium processing (a paid option for a guaranteed 45-day decision or refund) to Form I-140 immigrant worker petitions, effective January 30, 2023: EB-1C multinational executive/manager petitions and EB-2 National Interest Waiver petitions became eligible, including brand-new (not just previously-filed) petitions in both categories for the first time.

Current status

Premium processing is an optional, separately-filed, paid upgrade (Form I-907) — it changes how fast USCIS must respond, not the substantive eligibility standard a petition is judged against. A petition without premium processing filed follows USCIS's regular, non-guaranteed processing time for its service center and category.
